The Postal Service is committed to sustainable practices and environmental responsibility and encourages suppliers to improve their environmental sustainability practices in the performance of this contract. Where appropriate, the postal service shall cooperate with the supplier to identify opportunities to improve the environmental and sustainability performance of the goods and services provided by the supplier. Postal services encourage suppliers to develop and offer innovative business practices focused on sustainability and to offer goods and services that help the postal service operate in a more environmentally sustainable way. Innovative sustainability business practices can take the form of improved and more sustainable business processes, replacing materials used in performance with more sustainable materials, combining sustainable materials with other materials resulting in a reduction in total cost of ownership, or otherwise. If the proposed innovation leads to an improvement in sustainability or otherwise promotes the objectives of the postal service, the postal service (1) may share with the supplier any savings resulting from the innovation; or (2) increase the quantities required; (3) or extend the term (including options) of this Agreement. Additional quantities must not exceed 100% of the amount required in this contract and term extensions must not exceed two years, including options. Equal opportunities before subcontracting The contractor appoints an AD (COR) who is responsible for the day-to-day management of the contract and acts as Swiss Post`s contact person with the supplier for all day-to-day matters. A copy of the notice of appointment setting out the CoR`s powers shall be given to the contractor when the contract is awarded. The supplier must carry out work on the site with its own organization that corresponds to at least __ percent of the total amount of work to be performed under this contract.

The percentage of work to be performed by the Contractor may be reduced with the written consent of the Contractor. Regardless of actual changes in labor and material costs during the period of performance of this Agreement, price adjustments required by such changes will only be made under the conditions set forth in this clause. The contracting authority shall specify in the list of contracts an adaptation formula describing the elements used to determine the adjusted contract price. The adjustment formula may indicate, where appropriate, all or part of the following: The postal service will pay the supplier on presentation of invoices or vouchers approved by the contract agent or a person designated as follows: The guarantee clause, also known as the Republican Government Clause, is contained in Article IV, Section 4 of the United States Constitution. and demands that the United States guarantee each state a republican form of government and provide protection against foreign invasion and domestic violence. Progress payments will be made to the Supplier if requested during the work, but not more often than monthly, in the amounts approved by the Customer under the following conditions: The estimated cost of this contract is $___. During the performance of this contract, former postal officials or executives of the Postal Career Executive Service (PCES) are prohibited from being employed by the Contractor as key personnel, experts or consultants if, within 1 year of their departure from the postal service, such persons would perform substantially the same functions as during their career in the postal service. The description of the components in the specification using brand or manufacturer names indicates that there is no other acceptable source for these components known to the postal service. However, those descriptions should not be restrictive and the supplier may request the contracting authority to recognise as equivalent to one of the specified components a component proposed by the supplier which is not included in the specifications and to authorise its replacement; provided that the supplier submits any request for replacement in good time and with sufficient information to enable the contracting entity to easily determine whether the proposed component actually corresponds to the component described in the specifications. The approval or rejection of the replacement request by the Contractor is final and is not subject to clause B-9: Claims and Disputes.

Once paragraphs 1 and 2 have been completed above, the Contractor shall, at the written request of the Supplier, fairly adapt all contractual provisions affected by the return, disposition or repair in accordance with the modification clause. The foregoing adaptation provisions are exclusive and the Postal Service is not responsible for the delivery of the Postal Service goods provided “as is” under any condition other than that in which they were originally offered. If the regular route of a contractual route is impracticable and the provider provides the full service via another longer route, the provider`s compensation for that service will be reasonably increased; provided, however, that such increase; “The invention described in this document was made under a contract or subcontract with the United States Postal Service.” Requirements for the subcontracting of small, minority and women`s enterprises Except with the prior consent of the contractor, the supplier undertakes not to indicate in its public statements or commercial advertising the fact that it has received a postal service contract or to imply in any way that the postal service supports its products. Note 1: May be modified by the contract agent from 30 to 90 days. Note: May be modified by the contract agent in contracts with non-profit organizations in the amount of $10,000. For the purposes of this clause, the annual rate of the contract includes an indexed component of the fuel price consisting of a price per gallon multiplied by the agreed number of gallons. Starting with the first full calendar month of performance, the indexed component of the fuel price is calculated by multiplying the DOE ppg of the previous calendar month by the agreed number of gallons, resulting in an increase, decrease or maintenance of the annual contract rate from month to month. As used in this Agreement, the following terms shall have the following meanings: Assignment of this Agreement or an interest in this Agreement that does not comply with the provisions of this clause shall constitute grounds for termination of the Agreement due to a defect at the choice of the Postal Service. Where a guarantee providing a guarantee under this contract becomes unacceptable to the postal service or does not submit reports on its financial situation at the request of the contracting authority, or if the contract price increases to the point where the public representative considers that the security provided becomes insufficient, the contractor shall immediately provide additional guarantees: necessary for the protection of the interests of the postal service and of persons providing labour or manpower.

Materials in performance of this Agreement. This contract may be terminated by the Post Office with at least 24 hours` notice or by the Supplier with at least 15 days` notice; without taking into account additional damages or payments instead of damages. The United States guarantees each state of this Union a republican form of government and protects each of them from invasion; and at the request of the legislature or executive (if the legislature cannot be convened) against domestic violence. .
